FLORIDA CIVIL RIGHTS ACT OF 1992
The Florida Civil Rights Act of 1992 can be found at Florida Statutes, Sections 760.01 and following. Like the U. S. Civil Rights Act, it prohibits employers of 15 or more employees from discriminating against persons on the basis of race, sex, religion and national origin. It goes even further and also prohibits discrimination based on age or marital status. The court cases interpreting the application of the U. S. Civil Rights Act have been adopted by the legislature to apply to interpretations of this state law. Therefore, in Florida any act which constitutes a violation of Title VII of the Civil Rights Act of 1964 will probably also be a violation of the Florida Civil Rights Act of 1992.
A charge of discrimination should be filed under oath with the Florida Commission on Human Relations ("FCHR"), which has responsibility for enforcing the law.
